Terms of Service

These Terms of Service ("Terms") are an agreement between you and Spark Ventures ("Spark", "we", "us"), operator of the Spark app and website at get-sparkd.com. By creating an account or using Spark, you agree to these Terms.

1. What Spark is

Spark is a peer-to-peer recognition platform that allows people to send small monetary gifts along with messages of appreciation to recognize kindness, great service, and meaningful acts. Spark is not a fundraising or donation platform, not a payroll or tipping-compliance service, and not an escrow service.

Spark is not a bank. We do not take deposits, we do not hold funds as a depository institution, and balances shown in the app are not insured deposits. Money movement is performed by our third-party payment partner.

4. Claiming a Spark

A one-time Spark code must be claimed by the recipient within the claim period, currently 72 hours from creation. Unclaimed Sparks expire and are returned to the sender. Full details are in our Refund & Unclaimed Spark Policy.

6. Fees

Spark may charge fees for certain transactions or features. Any applicable fee will always be clearly disclosed before you confirm a transaction. Instant Deposit or other expedited payout options may be offered with a separately disclosed fee.

7. Transaction and account limits

Spark may establish or adjust transaction limits, account limits, or sending and receiving limits for security, fraud prevention, compliance, or operational reasons. Any limit that affects your ability to complete a transaction will be communicated in the app.

8. Simulated mode

Spark may operate in a simulated or test mode during pre-launch testing. In simulated mode no real money moves, balances are for demonstration only, and no payout will occur. We will make it clear in the app when live payments are enabled.

9. Prohibited use

You may not use Spark for fundraising, donations, charitable solicitation, invoicing, payment for goods or services, gambling, adult content, illegal activity, money laundering, evasion of sanctions, harassment, or any activity restricted by our payment partner. See our Community Guidelines.

10. Public sharing

Recipients — and only recipients — decide whether a Spark is shared publicly on the Spark home feed or kept private. If shared, the sender name, recipient name, amount, badge, and message may be shown publicly.

11. Taxes

You are responsible for determining and paying any taxes that apply to money you send or receive. Spark does not provide tax or legal advice. Our payment partner may issue tax forms where required by law.

12. Suspension and termination

We may suspend, limit, or close an account that violates these Terms, creates risk or legal exposure, or that our payment partner declines to support. You may stop using Spark at any time and request account deletion at support@get-sparkd.com.

13. Disclaimers and limits

Spark is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Spark Ventures is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount of the transaction giving rise to the claim.

14. Changes

We may update these Terms. Material changes will be posted here with a new "last updated" date, and continued use means you accept the updated Terms.
